นับตั้งแต่วันที่ 4 กรกฎาคม 2481 เป็นต้นมา
ประเทศไทยได้กลับมีเอกราชทางศาลอย่างสมบูรณ์อีกครั้ง หลังจากที่ได้เสียเอกราชทางนี้ให้แก่ประเทศมหาอำนาจต่างๆ
ไปรวมเป็นเวลา 83 ปี
Since 4 July 1981, Thailand has once again regained its
judiciary independence after having been deprived of this independence to the
great power for a period of 83 years.
การที่ประเทศไทยจำต้องเสียเอกราชในทางนี้นั้นประเทศเหล่านั้นอ้างว่ากฎหมายไทยแต่เดิมมาไม่เพียงพอที่จะบังคับแก่กรณีทั้งปวงที่เกิดในสังคม
ไม่มีการจัดเป็นหมวดหมู่ยากแก่การศึกษาค้นคว้าและบางอย่างก็พ้นสมัย เช่น
การบีบบังคับจำเลยในคดีอาญาให้รับสารภาพโดยใช้วิธีทรมานต่างๆ เป็นต้น
The reason why Thailand was forcibly deprived of this
independence was because those great power alleged that Thai laws at that time
were not sufficient to enforce all legal cases in society, that time was no
classification of the law to facilitate the study and research, and that some
of them were obsolete, such as exercising pressure on the accused in criminal
case by torturing them for their confession.
เมื่อประเทศไทยได้แก้ไขระบบกฎหมายและกระบวนการยุติธรรมใหม่
ตามระบบแบบแผนของอารยประเทศแล้ว จึงสามารถกู้เอกราชด้านนี้คืนมาได้ และเป็นผลทำให้ชาวต่างประเทศทุกชาติ
ทุกภาษาในฝืนแผ่นดินไทยต้องอยู่ภายใต้กฎหมายไทย
และในเขตอำนาจศาลไทยดังที่เป็นอยู่ทุกวันนี้
After Thailand had improved and amended its legal system and
its judiciary process according to the system and custom of those civilized countries,
it was only then that it was able to restore its independence in this field,
thereby subjecting all foreigners under the Thai laws and under jurisdiction of
the Thai courts of justice as it is now.
