สะกิดศัพท์กฎหมาย ตอนความผิดฐานทำให้เสื่อมเสียอิสรภาพ
1.ข้อเท็จจริงฟังได้ชัดว่า
จำเลยได้ใช้มีดปลายแหลมจ่อจี้บังคับให้บุคคลอื่นขับรถไปให้ตามความประสงค์จำเลย

2. เมื่อไปพ้นแล้วจำเลยก็จอดรถทิ้งไว้ข้างทาง
(After having been’ out of
danger, the accused parked the car at the roadside.)
3.จำเลยไม่มีเจตนาที่จะถือเอารถคันนั้นอันจะเป็นการลักทรัพย์
(The accused did not have any
intention to take possession of the car for fear of being charged with theft.)
4.แต่อย่างไรก็ดีแม้จำเลยจำไม่มีเถยจิตเป็นโจร
การกระทำของจำเลยเป็นการขู่เข็ญขืนในให้เข้าจำเต้องยอมกระทำตามความประสงค์ของจำเลย
(However, ever though the
accused had no criminal inclination, his action was tantamount to a threat and
an intimidation on the other person which forced the latter to do whatever the
accused wanted.)

แต่มีความผิดฐานทำให้เสื่อมเสียอิสรภาพ
(The accused is not guilty of
theft, but is guilty of being prejudiced of one’s liberty.)
